Supreme court final day Health Care decision.

scotusblog.wpengine.com
Live blog it starting at 9 am EST , with decisions due after 10 am EST. so in 3 or so hours we should know if Obama care will stand.

This means Romney and Obama are waiting for the decision, because this decision will decide how they handle the health care issue.

It would not be surprising if this decision tilts the election one way or the other.

Not to mention possibly changes everyone in the US's health insurance.

Not everyone will get to keep their old plan, it is cheaper for companies to dump people onto the government system and pay the fine.

Still the big question remains, can the government force you to buy a product just for being alive?

CNN says opposite.

The Supreme Court has struck down the individual mandate for health care.

Medicare provision is limited but not invalidated.

It seems to be a very long decision. I think depending on what part of it you read out of many many pages, different things stick out.

Everyone's confused it seems.

[Updated at 10:06 a.m. ET] In a landmark decision that will impact the nation for decades, the Supreme Court on Thursday struck down a key provision of President Barack Obama's health care law, ruling that requiring people to have health insurance violates the Constitution.

I trust SCOTUSBlog more that CNN:

Quote:
The bottom line: the entire ACA is upheld, with the exception that the federal government's power to terminate states' Medicaid funds is narrowly read.

My only guess is that they are telling congress to rewrite it as a tax?

Or that it is a tax and a non tax mandate would not be legal?

Seems Kenendy voted against it.

CNN changed their headline, if they goofed this may be a nail in their coffin.

The money quote from the section on the mandate: Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it.

The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate.

Kennedy voted agaisnt Roberts for.
CNN now says it's upheld.

I'm still confused on the simply refuse to pay the tax part.

Yes they had a Dewy Beats Truman moment on this one.....

They now show:
Quote:
[Updated at 10:16 a.m. ET] Kate Bolduan reports that the Chief Justice John Roberts issued a long opinion in which he said the controversial individual mandate may be upheld and is within Congress’ power under the taxing clause rather than the commerce clause.
[Updated at 10:15 a.m. ET] The Supreme Court has upheld the entire health care law by a vote of 5 to 4, Supreme Court Producer Bill Mears said. That includes the medicare provision

Amy Howe: On the Medicaid issue, a majority of the Court holds that the Medicaid expansion is constitutional but that it w/b unconstitutional for the federal government to withhold Medicaid funds for non-compliance with the expansion provisions. Thursday June 28, 2012 10:21 Amy Howe
10:22 Lyle: The key comment on salvaging the Medicaid expansion is this (from Roberts): "Nothing in our opinion precludes Congress from offering funds under the ACA to expand the availability of health care, and requiring that states accepting such funds comply with the conditions on their use. What Congress is not free to do is to penalize States that choose not to participate in that new program by taking away their existing Medicaid funding." (p. 55)

So the states won on medicaid completly. They do not have to do anything about it.

This alone will serisouly blunt Obamacare, and create a major unworkable situation where most states will decline to expand medicaid since it will cost them an arm and a leg. Which means you now have a whole class of people who are going to get screwed by the mandate.

Politically this may be a Republican win.

Right now all the commentators are just going by the verbal reading of the opinion, which is a shortened version. None of them have hard copy yet. That is where the detail analysis starts.
